一、服务内容

Osilearn（奥思）（下称“本产品”）由摩星泰乐（北京）科技有限公司（下称“我们”）运营，包括微信小程序、机构管理网站和官方网站。

本产品为教育机构（下称“机构”）及其会员家庭提供课堂记录、课后练习、作业与任务、学习进度和报告、课堂资料管理，以及由人工智能辅助的老师备课、课堂反馈、AI 老师和作业助理。

各项功能以机构开通的范围为限。机构的线下课程由机构自行提供，不属于本产品的服务内容。

二、账号

本产品使用微信账号登录。一个微信账号只能持有一种身份：家长，或机构的老师、管理员。

家长：添加孩子的用户须为该孩子的父母或其他监护人，并对孩子使用本产品负责。每个孩子档案仅供该孩子本人使用。

老师和管理员：由机构通过邀请码邀请，加入须经机构确认。你的账号由所属机构管理，机构可以暂停或移除。

班级码、邀请码仅供本人使用，不得转发给无关人员。加入班级、成为老师均需机构确认。练习数据明显异常时，机构可核实情况并暂停相关档案。

请妥善保管你的微信账号。通过你的账号进行的操作视为你本人的操作。

三、机构与个人信息

机构是其学生、家长和老师在该机构信息的个人信息处理者；我们受机构委托处理这些信息。机构应当依法取得监护人的同意，并与我们签订委托处理协议。

个人信息的处理规则见《隐私政策》和小程序内的《儿童个人信息保护规则》，两者是本协议的一部分。

机构的老师和管理员只能为教学和管理目的使用学生信息，不得导出、转发或用于其他目的。

四、使用规范

使用本产品时，你不得：

• 上传、发布违法、有害或侵犯他人权利的内容；
• 未经授权录入他人的个人信息；上传的照片应为板书、作业等内容，不应包含他人的面部；
• 复制、录屏、下载或传播本产品中的书页、音频、视频等内容；
• 干扰本产品的正常运行，或以自动化手段批量访问；
• 冒充他人，或让他人使用你的账号。

违反上述规范的，我们或机构可以暂停或终止相关账号。

五、知识产权

本产品的软件、界面、商标和我们制作的内容归我们所有。

书页、音频等课程内容由机构授权提供给其会员家庭，仅供家庭练习使用，使用范围以机构获得的授权为限。

你上传的课堂资料和内容仍归你或机构所有；你授权我们为提供服务所必需的范围内存储和展示它们。

六、人工智能生成内容

AI 老师、作业助理、AI 备课、课堂反馈草稿和每周小结由生成式人工智能生成，均标注“AI 生成”。

AI 生成的内容可能不准确或不完整，仅供参考。老师发布给家长的 AI 草稿，由老师核对后负责；孩子的学习以老师的判断为准。

我们对 AI 功能设置使用上限和内容安全检测，并可能在检测到风险时拒绝回复。

七、费用

本产品的服务费用由机构与我们另行签订的合同约定，家长无需向我们付费。

机构对其家庭收取的任何费用，由机构与家庭之间约定，与我们无关。

如本产品内向家长提供付费项目，其价格、期限和退款规则以购买时页面展示为准。

八、变更与终止

服务内容如有变更，我们会在产品内提示。

你可以随时在“我的”中删除孩子或删除账号。老师和管理员可以退出机构。

机构终止合作后，其数据保留 30 天供其导出，然后删除。

你严重违反本协议时，我们可以终止向你提供服务。

九、责任

我们按现有技术提供服务，并尽合理努力保障服务稳定、安全。因不可抗力、第三方服务（微信、腾讯云等）故障或你自身原因导致的损失，我们在法律允许的范围内不承担责任。

我们不对机构的线下教学、机构与家庭之间的约定承担责任。

在法律允许的范围内，我们对你的全部赔偿责任以你或你所属机构在争议发生前十二个月内为本产品实际支付的费用为限。

本条不限制法律规定不得免除的责任。

十、法律适用与争议解决

本协议适用中华人民共和国法律。因本协议产生的争议，双方应先友好协商；协商不成的，提交北京市房山区有管辖权的人民法院解决。

十一、其他

本协议中文版本为具有法律效力的版本，英文译文仅供参考。

本协议更新时，我们会在产品内提示；继续使用即视为同意更新后的协议。页首的版本日期即生效日期。

1. The service

Osilearn (the "product") is operated by Moxing Taile (Beijing) Technology Co., Ltd. ("we") and comprises a WeChat mini program, a school admin website and the website.

The product gives educational institutions ("schools") and their member families lesson records, home practice, homework and tasks, learning progress and reports, class-material management, and AI-assisted lesson prep, lesson feedback, an AI tutor and a homework assistant.

Features are available to the extent the school has enabled them. A school's offline lessons are provided by the school and are not part of the product.

2. Accounts

Sign-in is with a WeChat account. One WeChat account holds one role only: parent, or a teacher or administrator of a school.

Parents: only a child's parent or other guardian may add that child, and is responsible for the child's use of the product. Each child profile is for that child alone.

Teachers and administrators: invited by the school with an invite code; joining needs the school's confirmation. Your account is managed by your school, which may pause or remove it.

Class codes and invite codes are personal and must not be passed on. Joining a class or becoming a teacher needs the school's confirmation. Where practice data is clearly abnormal, the school may check and pause the profile concerned.

Keep your WeChat account safe. Actions taken through your account count as yours.

3. Schools and personal information

A school is the controller of its students', parents' and teachers' information held for that school; we process it on the school's behalf. The school must obtain guardians' consent as the law requires and sign a processing agreement with us.

How personal information is handled is set out in the Privacy Policy and the Children's Privacy Rules in the mini program; both form part of these terms.

A school's teachers and administrators may use student information for teaching and administration only, and may not export, forward or otherwise use it.

4. Acceptable use

You must not:

• upload or publish unlawful or harmful content, or content that infringes the rights of others;
• enter other people's personal information without authority; photos you upload should show whiteboards, homework and the like, never other people's faces;
• copy, screen-record, download or distribute book pages, audio, video or other content in the product;
• interfere with the product or access it in bulk by automated means;
• impersonate anyone or let anyone else use your account.

We or the school may pause or end an account that breaks these rules.

5. Intellectual property

The software, interface, trademarks and the content we produce belong to us.

Course content such as book pages and audio is licensed to a school for its member families, for home practice only, within the scope of the school's licence.

Materials and content you upload remain yours or your school's; you permit us to store and display them as far as providing the service requires.

6. AI-generated content

The AI tutor, homework assistant, AI lesson prep, feedback drafts and weekly summaries are produced by generative AI and labelled "AI 生成" (AI generated).

AI content may be inaccurate or incomplete and is for reference only. A teacher who publishes an AI draft to parents is responsible for checking it; a child's learning follows the teacher's judgement.

AI features have usage caps and content safety checks, and a reply may be refused when a risk is detected.

7. Fees

Fees for the product are set in a separate contract between the school and us; parents pay us nothing.

Any fee a school charges its families is a matter between the school and the family and does not involve us.

If paid items are offered to parents inside the product, their price, term and refund rules are those shown at the time of purchase.

8. Changes and termination

Changes to the service are announced in the product.

You may delete a child or your account at any time under 我的 (Me). Teachers and administrators may leave their school.

After a school ends its contract, its data is kept for 30 days for export and then deleted.

We may stop providing the service to you if you seriously breach these terms.

9. Liability

We provide the service with the technology available and make reasonable efforts to keep it stable and secure. To the extent the law allows, we are not liable for loss caused by force majeure, by failures of third-party services (WeChat, Tencent Cloud and the like) or by your own actions.

We are not responsible for a school's offline teaching or for agreements between a school and a family.

To the extent the law allows, our total liability to you is limited to the fees you or your school actually paid for the product in the twelve months before the dispute arose.

Nothing in this section limits liability that cannot be excluded by law.

10. Governing law and disputes

These terms are governed by the laws of the People's Republic of China. Disputes are first settled by negotiation; failing that, they are submitted to the competent people's court in Fangshan District, Beijing.

11. Other

The Chinese text of these terms is the binding version; the English is a courtesy translation.

When these terms change we notify you in the product; continued use counts as acceptance. The version date at the top is the effective date.
